Terms and Conditions
Flipside Travel
These Terms and Conditions apply to bookings made with Flipside Travel Pty Limited ABN 85 701 281 558 (“we” or “our”) for you and all persons named in your booking (including persons added or substituted after the booking is made) (“you” or “your”).
We rely upon your acknowledgement that you have read, understood and agree to be bound by these Terms and Conditions, when we accept your booking request.
We reserve the right to change these Terms and Conditions at any time prior to your booking confirmation.
Bookings and payments
- The booking services we provide are as stated on our website / advertising.
- To make a booking, enquiry you must complete an enquiry form online and provide the information requested. The information requested will include your email, mobile phone number, trip details including pick up/drop off locations and dates, preferred vehicle style, and any additional information you desire to provide or requests you desire to make.
- The booking enquiry will be received on our CRM system as a new enquiry. Our website and CRM will be linked, and this will form a communication channel with you, whether by WhatsApp, Facebook, email or phone.
- We will provide you a list of vehicles to choose from (from suppliers we work with), and a recommendation as to which vehicle to choose. We will also provide you the supplier’s own excess reduction (insurance) to choose from.
- On receiving your choice of vehicles, and excess reduction (insurance), we will provide you with an official quote on a Flipside branded document, including a discount applied by us.
- If you accept our quote, we will issue you an invoice for the booking.
- You must pay the deposit (as invoiced) within the time stated on the invoice. We reserve the right to cancel your booking if the deposit is not received within the time stated on the invoice.
- The balance price (as invoiced) will be payable after we use the supplier’s B2B systems to book the vehicle. You will either pay us or the supplier directly, as directed on the invoice. You make the payment either by inputting your card details on the link provided, or, by arrangement, our taking payment and card details over the phone.
- The supplier will send booking confirmation to us, and we will forward it to you. From that time, your contract is directly with the supplier, and our involvement is at an end.
- We reserve the right to accept or reject your booking enquiry, at any time, at our absolute discretion.
- No binding legal obligations to provide the booking will arise until full payment of the price has been received.
- Amounts payable are invoiced and payments are to be made in Australian Dollars ($AUD) where payments are to be made to Australian suppliers, and in New Zealand Dollars ($NZD) where payments are to be made to New Zealand suppliers.
- Payments are to be made via a payment system such as by credit card or direct bank transfer.
- If you do not provide the correct information when you make your booking, then you will be responsible for any amendment or re-issue fees charged by our suppliers, in addition to our administration fees.
- If you place a booking on behalf of another party, you represent and warrant us that you are duly authorised to provide the agreement and consent of the other party to be bound by these Terms and Conditions.
Amendments, additional requests and cancellations (by you)
- We will endeavour to accommodate amendments and additional requests for your booking but cannot promise to fulfill them.
- We will not charge an amendment fee for amendments to dates after you pay the deposit. However, rates and availability are subject to cost increases from the suppliers.
- A request to transfer the booking may be treated as a cancellation if we are unable to transfer the booking.
- We will pass on cost increases and amendment fees charged by a supplier for amendments and additional requests made by you.
- Amendments, additional requests and cancellations must be notified in writing (by email).
- Deposits are non-refundable. Deposits are transferrable to another booking made within 12 months of your cancellation, in the event you cancel the booking before the commencement of the booking and to the extent the deposit is not applied towards cancellation fees charged by the suppliers.
Cancellations, rescheduling and alternative arrangements (by us)
- We may alter the booking according to changes made by our suppliers. If so, we will notify you as soon as practicable and will try to put in place an alternative booking for your benefit, which is acceptable to you. We will pass on any extra costs incurred.
- In these Terms and Conditions, the term Force Majeure Event means an event or events beyond our control and which we could not have reasonably prevented, and includes but is not limited to:
(a) natural disasters (including not limited to flooding, fire, earthquake, landslide, volcanic eruption), adverse weather conditions (including hurricane or cyclone);
(b) war, armed conflict, industrial dispute, civil strife, terrorist activity or the threat of such acts; epidemic, pandemic;
(c) any new or change in law, order, decree, rule or regulation of any government authority (including travel advisory warnings and restrictions, and border closures).
- If in our reasonable opinion (either directly or through our employees, contractors, suppliers or agents) we consider that the booking cannot safely or lawfully commence due to a Force Majeure Event or a supplier insolvency or bankruptcy, then at our discretion we may elect to either:
- reschedule the booking (in whole or in part); or
- substitute a new booking; or
- alter the booking; or
- cancel the booking.
- If we cancel the booking, we will refund the price less:
- unrecoverable third party costs and other expenses incurred by us;
- administration charges incurred by us; and
- fair compensation for work undertaken by us in relation to the cancelled booking and in connection with the processing of any refund.
- Refunds for cancellations by us cannot be provided to you until our supplier has released the funds to us.
- The deposit is not refundable in any circumstances.
Travel Insurance
- We strongly recommend you take out travel insurance which provides comprehensive cover for the booking when we provide the booking confirmation.
- The travel insurance should include cover for cancellation, medical and dental expenses, repatriation, evacuation, loss and damage to baggage, public liability and loss of documentation. If you intend to engage in adventurous activities, the travel insurance policy should be extended to include cover for those activities.
Responsibility
- You acknowledge that our services are to make bookings with suppliers, and not to perform the services booked.
- The suppliers we select are reputable independent suppliers capable of performing the services booked.
- To the fullest extent permitted by law, we will not be responsible to you or be liable for any loss, damage, personal injury or delay attributable to the acts or omissions of a supplier who performs the booking. Nor will we be responsible for any defects, delays, accident damage, insurance in respect of any vehicle provided by a supplier. Any claims you have in this regard must be made against the supplier. You acknowledge that the supplier’s liability to you may be limited by their own terms and conditions.
General Liability Limitation
- To the extent only that we are engaging in booking services (which we control), then we will provide those services with reasonable skill and care. We will be responsible for our employees in the course of their employment, and for our agents and suppliers who assist in our providing our booking services.
- We will not be responsible for any loss, damage, claim or expense caused by the acts or omissions of yourself, of any other third party not connected with the provision of the booking services.
- We will not be responsible for any loss or additional expenses you incur for any missed connections/services attributable to events which are outside of our control.
- You are responsible to have valid travel documentation including a passport with at least 6 months validity from due date of return, visas and inoculations.
General
This contract is governed by the laws of the State of New South Wales for vehicles booked for use in Australia. This contract is governed by the laws of the New Zealand for vehicles booking for use in New Zealand. Any disputes shall be dealt with by a court with the appropriate jurisdiction according to where the vehicle is booked for use.
If any provision of these Terms and Conditions is found to be unenforceable, then to the extent possible, it will be severed without affecting the remaining provisions.
Any personal information you provide to us will be collected, stored, used, protected and shared in accordance with Australian Privacy Principles.
